1 INCLUDED IN CASE OF DAMAGE AND/OR ACCIDENT
1.1 Personal Accident Insurance (also called PAI in English, abbreviated from Personal Accident Insurance) covers the renter, additional drivers, the car’s passengers, and third parties.
1.2 Collision/accident insurance (also called CDW in English, abbreviated from Collision Damage Waiver) covers ALL damages to the car both in case of an accident by the renter and in accidents involving third parties.
1.3 Theft Protection (TP in English, abbreviated from Theft Protection) covers the theft of the car itself, provided that the renter returns the CAR KEY to the car rental company.
1.4 Personal belongings left in the car are not covered. The car rental company is not responsible for personal items left in the car after the rental period has ended.
1.5 Scratches and dents in the paint, windows and mirrors, wheels and tires (also in case of puncture), front and rear lights, undercarriage and clutch, and towing costs associated with damage, accident or breakdown.
1.6 This also applies if damages are caused by the renter, accompanying drivers, and/or third parties.
1.7 The aforementioned is included PROVIDED THAT A WRITTEN REPORT IS SENT OR DELIVERED TO THE CAR RENTAL COMPANY with: pictures of the damage, a brief description of the event, place, time, and names of involved parties. We are KIND AND EASY to talk to and suggest using either email or WHATSAPP to submit a damage report. (we do not accept being informed of damages at the return of the car or after the rental period has ended).
1.8 We do our best to keep all left/lost items we find in the cars after their return, but the car rental company DISCLAIMS ALL RESPONSIBILITY FOR LOST ITEMS IN THE CARS AFTER THE RENTAL PERIOD HAS ENDED, (such as sunglasses, remote controls, iPads, phones, keys, etc.)
2 NOT INCLUDED
2.0 Any damage caused by negligent use of the car.
2.1 Damages that have not been reported to the car rental company according to section 1.7
2.2 Damages caused due to improper driving and/or parking (such as damage to rims/tires by hitting the curb while parking)
2.3 Damages to the undercarriage and body caused by negligent driving such as driving on gravel roads/mountain roads (in Spanish “carril”).
2.4 Misuse of clutch, lost antenna, damage to seat upholstery, unusually dirty interior/upholstery, locks, keys, filling up with the wrong fuel, transporting animals, use for towing another car, and costs associated with the aforementioned.
2.5 Damages caused due to not following the dashboard’s warning signals.
2.6 Damages caused in connection with towing another vehicle.
2.7 Driving the vehicle out of Spain without express permission and insurance for it from the car rental company.
2.8 Using the vehicle after the rental period has expired.
2.9 In case of breakdown or accident, leaving the vehicle in a position that could expose it to further damage or theft.
2.10 Any speeding ticket, parking fine, or fine for violations of the law. A MANDATORY fixed administrative fee of €15 is added for the administration of fines on behalf of the renter.
3 DELIVERY AT MALAGA AIRPORT
3.1 We deliver ALL CARS PERSONALLY 24/7/365 in the period 08:00 – 21:00 WITHOUT extra charge.
3.2 For deliveries between 21:00 – 08:00, a fixed fee of €20 is added for staff overtime pay.
3.3 From 21:00 this fee is added without exceptions.
3.4 The decisive moment is when you meet us in the arrivals hall, NOT the flight’s arrival time.
3.5 Late delivery fee must ALSO be paid even if it does not appear on the confirmation (which it naturally won’t if, for example, you have indicated the flight’s arrival time to be 20:15 – 20:30 or 20:45).
3.6 This also applies if you land at 19:00 but are delayed, regardless of the reason, and do not come out to meet us before 21:00.
3.6 Request for delivery to holiday address/hotel by inquiry which kindly should be addressed before sending the booking request.
3.7 Delivery to holiday address or hotel costs €20
4 RETURNING THE CAR AT MALAGA AIRPORT
4.1 The car can be returned at Malaga airport in the period 08:00 – 21:00 WITHOUT costs.
4.2 Returning in the period 21:00 – 08:00 costs €15 in a fixed fee (this covers parking costs in the early morning hours until staff can retrieve the car).
4.3 The car is returned EASILY and CONVENIENTLY in the P-1 parking garage located right opposite the terminals at Malaga airport.
4.4 Exact instructions regarding the return of the car will be given at the delivery of the car.
4.5 If the car is left elsewhere than where indicated, all costs associated will be charged to the renter. Do NOT leave the car in Parking Express
4.6 If the car is not returned at the agreed time and place, it will be reported stolen.
4.7 Return to holiday address/hotel by inquiry and against a fee of €20
5 PAYMENT UPON ARRIVAL
5.1 Payment is made at the delivery of the car, directly to the staff delivering it.
5.2 No reservation fee is charged, and NO credit card number is provided on the booking form when the car is booked online.
5.3 We accept VISA and MasterCard (also debit cards such as visa electron and Visa Dankort).
5.4 In addition to the confirmed amount, we do not charge any “deposit” or excess as a guarantee, and we do not “block” any amount on the card.
5.5 For the debit card to be valid, the first of the card’s 16 digits must be 4 or 5.
5.6 The payment card MUST be in the renter’s name (not in the additional driver’s name).
5.7 Payment can therefore NOT be made by others than the renter himself.
5.8 We accept CASH payment in the exact amount in € – this is selected on the booking form.
5.9 Regardless of the chosen payment method, the renter MUST be able to present a payment card WHICH WE NOTE ON THE CONTRACT.
5.10 The card is noted solely as our guarantee to be able to charge any outstanding amount such as missing fuel at the return of the car, unusual dirtiness of seats/upholstery, traffic violations, or other negligent use, etc. not included in the price.
6 FUEL POLICY
6.1 Fuel for the renter’s own consumption is, of course, NOT included in the rental price.
6.2 NO payment for a full tank of fuel is made at the delivery, and NO “refilling fee” is charged when the car is returned.
6.3 The car is delivered with a 1/2 tank of fuel (or more) and should be returned with the same amount of fuel as at the delivery.
6.4 The fuel level will be precisely noted on the rental contract signed by both parties (and WILL be carefully checked at the return of the car).
6.5 If the car is returned with less fuel in the tank than at delivery, the renter will be charged an administration fee of €25 + missing fuel. To be on the safe side, we recommend refuelling at the BP station at Malaga Airport (not in Nerja or Marbella, etc.)
7 CHILD SEATS AND BOOSTER CUSHIONS – FREE
7.1 We gladly provide child seats and booster cushions/seat cushions FREE of charge (something most companies charge about €3- €6 per rental day for as an extra fee).
7.2 Due to Spanish legislation, child seats must be installed by the renter – not by the car rental company staff.
7.3 All child seats are approved according to European standards.
7.4 All child seats are forward-facing, except for MAXI COSY (0-9 months) which can be installed both forward-facing and rear-facing.
7.5 We do not provide car seats of more expensive brands.

7.7 All cars are equipped with the ISOFIX system
8 EXTRA DRIVER – FREE
8.1 Up to 4 additional drivers per rental contract can be added for FREE – please remember that this normally costs €5-€6 extra per rental day per person at other car rental companies in Malaga.
8.2 All additional drivers must possess a valid driving license at the delivery of the car/signing of the contract (Extra drivers can EASILY be added to the contract upon arrival).
8.3 For additional drivers who are NOT present at delivery, driving licenses can be sent scanned and attached by email.
9 GPS
9.1 English-speaking GPS can be selected on the booking form. Price €5 per day, maximum €35 per rental.
9.2 Not all cars have built-in GPS. If GPS is selected, we will deliver either a car with built-in GPS OR a separate GPS (English speaking).
9.3 To be assured of getting delivered a GPS, this must be selected on the booking form.
10 NECESSARY AND MANDATORY DOCUMENTATION
10.1 At the delivery of the car, the renter must be able to present:
- Passport
- Driving license
- Credit/debit card in OWN NAME (Visa or MasterCard)
11 AGE RESTRICTIONS
11.1 The minimum age is 25 years with 2 years of experience.
11.2 For drivers who have TURNED 70 years, the rental conditions are THE SAME, except that there is an excess of €300 for ALL car groups.
11.2.1 This excess cannot be eliminated.
11.2.2 NO AMOUNT will be charged in advance and NO AMOUNT will be “blocked” on the payment card.
11.2.3 The excess of €300 will only apply in case of damages or accident, wholly or partly, depending on the extent of the damages.
12 IMPROPER USE OF THE CAR
12.1 Improper use of the car is under no circumstances covered by insurance.
12.2 Any cost and/or financial loss that the lessor may suffer due to improper use of the car must be paid by the renter.
12.3 This applies especially to: hitting the curb while parking thereby damaging tires and/or rims, damage to body/undercarriage due to driving on mountain roads (in Spanish “carril”), reckless driving, driving the car under the influence of alcohol or euphoric substances, driving the car after the contract has expired, not respecting traffic signals/speed limits, incorrect use of clutch, ignoring the dashboard’s warning signals.
13 RENTER’S DUTY IN CASE OF DAMAGES, BURGLARY OR BREAKDOWN
13.1 It is the renter’s duty to inform the rental company about damages or breakdown as soon as possible, within a maximum of 24 hours.
13.2 A short description of the event must be reported to the car rental company, this must be signed by the renter and must contain: place, date, time, persons involved as well as photos of the damages.
13.3 The damage report can easily be sent via email (with attached pictures) or, with a picture of a handwritten report plus pictures of the damage via WHATSAPP.
13.4 In case of breakdown, burglary, or accident, it is the renter’s duty not to leave the vehicle in a position that could expose it to further damage or theft of the car itself.
14 RENTER’S DUTY IN CASE OF ACCIDENT
14.1 To call the Police and make a police report, and if necessary, to make the report at the nearest police station (Policia Local or Guardia Civil)
14.2 To inform the car rental company about the accident immediately, as quickly as possible, and within a maximum of 24 hours.
14.3 If one or more third parties are involved, it is the renter’s legal duty to obtain the following information:
- License plates of all cars involved.
- Full name, ID and address in home country of all involved.
- Insurance company and policy number of all involved.
- Names and contact information of any witnesses, if any.
14.4 If the third party cannot identify themselves, or refuses to identify themselves, it is the renter’s duty to immediately call the police, and take pictures of the third party’s car and license plate.
14.5 In the car, there is a “Declaracion Amistosa de Accidente” or “friendly declaration” that can be filled out and used for a short description. A copy of this must be delivered to the car rental company.
14.6 Damages not reported according to the aforementioned will be charged to the renter, as well as damages reported after the rental period has ended.
14.7 False testimony/damage report will not be accepted.
15 CANCELLATIONS
15.1 Cancellations can be made for FREE up to 72 hours before the start of the rental period.
15.2 Cancellations received later than 48 hours from the start of the rental period will incur a cancellation fee of 20% of the confirmed rental price.
15.3 Cancellations received later than 24 hours from the start of the rental period will incur a cancellation fee of 30% of the confirmed rental price.
16 CARS AND CAR GROUPS
16.1 Cars are divided into car groups/classes according to size, number of doors, type of car, and capacity.
16.2 We GUARANTEE to deliver the reserved car group as will appear on the BOOKING CONFIRMATION
16.3 We do not guarantee a specific model, car brand, color, engine size, number of horsepower, engine type, fuel, etc.
16.4 All pictures on the website (which we do our best to keep updated) are examples of cars in each car group, and are for orientation. Any doubt or questions regarding cars, capacity, etc. kindly should be clarified BEFORE sending the booking request.
17 EXTENSION OF RENTAL CONTRACT
17.1 Extension of the rental contract can normally easily be done (by inquiry) and should be done at least 48 hours before the rental contract expires. However, an extension cannot be guaranteed if the particular car is rented out to another customer, especially in high season where all cars are rented out.
18 DRIVING TO PORTUGAL AND GIBRALTAR
18.1 Additional insurance for driving in Portugal: €60 per rental.
18.2 The car CAN be driven into Gibraltar without extra costs, BUT we advise against it, due to the fact that roadside assistance only covers in Spain and that problems/queues may arise at the border. Our best advice is to park on the Spanish side and walk across the border.
19 DOUBTS ABOUT THESE RENTAL TERMS
19.1 Any doubts about these easily understandable and very detailed rental terms that we have taken great care to prepare, KINDLY SHOULD BE CLARIFIED BY PHONE OR EMAIL BEFORE SENDING THE BOOKING REQUEST.
20 RESERVATIONS
20.1 The car rental company reserves the right to terminate the rental contract without notice in case of breach of rental conditions.
